1.3 Age Requirement

The Platform is available to individuals aged 18 and older only. By creating an account, you confirm that you are at least 18 years of age. Users under 18 are not permitted to register or use the Platform.

1.4 Membership & Subscription Terms

Membership Tiers: Available tiers include Lite, Standard, XP, Pro, Premium, and Premium Max.
Recurring Billing: Memberships renew automatically on your billing date unless canceled.
Cancellation: You may cancel your membership at any time through your account settings.
No Refunds: All membership purchases are final. No refunds are issued for any reason, including early cancellation, dissatisfaction with content, or service interruptions.
Billing Disputes: Contact Profe Jaimi immediately if you believe a charge is in error.

1.5 Payment Processing

Payment is processed by Stripe and PayPal. These processors handle all payment and billing information according to their own terms. We do not store or access your full payment card details. Refer to Stripe’s and PayPal’s privacy policies for their data handling practices.

1.6 Content Ownership & Usage Rights

Your Content: Any content you create, record, upload, or submit to the Platform (including speaking samples, written work, learning progress, and interactions with Coach Destiny) is owned by Profe Jaimi and English with Profe Jaimi.
Our License: By submitting content, you grant Profe Jaimi an unlimited, perpetual license to use, reproduce, modify, and distribute your content for any purpose, including marketing, platform improvement, AI training, research, and promotional materials, with or without attribution.
Platform Content: All other content on the Platform—including episodes, audio, courses, written materials, and Coach Destiny interactions—is owned by Profe Jaimi and protected by copyright. You may access this content for personal, non-commercial learning only.
No Resale: You may not resell, redistribute, or sublicense Platform content or memberships.

1.7 Prohibited Conduct

You agree not to:

Engage in spam, harassment, bullying, or abusive communication directed at other users or Profe Jaimi
Post or transmit illegal content or content that violates any law
Infringe on intellectual property rights (copyright, trademark, patent, etc.)
Use automated tools, bots, scraping scripts, or mechanical processes to access, monitor, or copy Platform content
Attempt to reverse engineer, decompile, or otherwise discover the source code or functionality of Coach Destiny or any proprietary technology
Share your login credentials or allow others to access your account
Resell, redistribute, or share your membership access with others
Manipulate Platform systems, disrupt service, or attempt unauthorized access
Collect personal data from other users without consent
Use the Platform for any commercial purpose without written permission from Profe Jaimi

Violation of these terms may result in immediate account suspension or termination without refund.

1.8 Account Termination

Profe Jaimi reserves the right to suspend or terminate your account immediately, without notice or refund, if you:

Violate any provision of these Terms of Service
Engage in prohibited conduct
Fail to pay fees or subscriptions as due
Pose a safety, legal, or security risk to the Platform or other users

1.9 Third-Party Services

The Platform relies on third-party service providers, including but not limited to:

No Warranty on Coach Destiny: Coach Destiny is an AI-powered coaching tool designed to support language learning. It is not a substitute for professional instruction or personalized tutoring. Profe Jaimi does not warrant the accuracy, completeness, timeliness, or effectiveness of AI-generated suggestions or assessments.
Third-Party Outages: We are not liable for service interruptions, data loss, or failures caused by third-party providers (Stripe, PayPal, Bunny CDN, LiveKit, etc.).
User-Generated Issues: We are not liable for losses or damages arising from your use of or inability to use the Platform, including any loss of data, revenue, or opportunity.

Limitation of Liability: Profe Jaimi’s total liability arising from or relating to the Platform shall not exceed the total amount you have paid to Profe Jaimi in the 12 months preceding the claim.

1.11 Modification of Terms

Profe Jaimi may modify these Terms of Service at any time, effective upon posting to the Platform. Your continued use of the Platform following any changes constitutes your acceptance of the modified terms. It is your responsibility to review these terms periodically.
